Personal Watercraft (PWC) Rental/Excursion Waiver

I. Introduction

Welcome to Jetcraft Water Adventures, LLC! Before participating in any PWC rental or excursion activities, we require all participants to read and confirm agreement of this Waiver Agreement. This document outlines the risks associated with PWC activities and the conditions under which they are undertaken. By confirming, via text, with this waiver, you agree to the terms laid out herein and acknowledge your responsibilities.

II. Acknowledgment of Risks

The activities involving PWC’s possess inherent risks that can be physically demanding and potentially dangerous. Accidents can occur that may result in injury or death. Risks include, but are not limited to, drowning, equipment failure, and collisions. Through agreement to this waiver, you voluntarily assume all risks associated with these activities.

III. Safety Rules and Regulations

Prior to rental or excursion activities, participants will receive a safety briefing and walk-around of the watercraft. It is also required to watch the Safety Instruction video found on this website.   It is mandatory to adhere to the following safety regulations to participate:

• Wear appropriate safety gear at all times.

• Follow instructions given during the safety briefing and walk-around.

• Do not operate the PWC under the influence of alcohol or drugs.

• Respect other participants and marine life.
  

IV. Insurance and Liability

Jetcraft Water Adventures, LLC carries liability insurance coverage for activities conducted under our supervision. However, this does not absolve participants from the risks associated with these activities. By agreeing to this waiver, you agree to not hold Jetcraft Water Adventures, LLC or its owner, liable for any injury or damage occurring during your participation in the PWC activities, unless it's due to the negligence or intentional misconduct of the company.

V. Medical Fitness

You affirm that you are in good health and physically capable of engaging in PWC activities. If you have medical concerns, please consult a doctor before agreeing to this waiver and participating in any activities.

VI. Consent and Release

By agreement to this waiver, you confirm your voluntary participation in these activities and consent to the terms outlined in this agreement. You also agree to release Jetcraft Water Adventures, LLC, and its owner, from any claims arising from your participation.

VII. Emergency Contact Information

Please text your preferred Emergency Contact Name and Contact Number to Jetcraft Water Adventures, LLC, following agreement to this waiver.

VIII. Agreement via text

By texting your agreement to this waiver to Jetcraft Water Adventures, LLC, you acknowledge that you have read and understand the terms of this waiver and voluntarily agree to be bound by them.
